    RESOLUTION NO. 716-06,  CHARTER AMENDMENT NO. 83

    RESOLUTION OF THE CITY OF ABERDEEN TO AMEND SECTION III OF THE CHARTER OF THE CITY OF ABERDEEN TO EXTEND THE CORPORATE BOUNDARIES AND TO DESIGNATE THE ZONING CLASSIFICATION OF THE LAND BEING ANNEXED.

    A Resolution of the City of Aberdeen, adopted pursuant to the authority of Article XI-E of the Constitution of Maryland and Section 19 of Article 23A of the Annotated Code of Maryland, 1957, (2005 Replacement Volume), entitled “Corporation, Municipal,” subtitle “Home-Rule,” subheading “Annexation,” to enlarge the corporate boundaries of the City of Aberdeen by amending the Public Local Laws of Maryland by modifying Section III(a), Corporate Limits of the Charter of the City of Aberdeen, to annex to said corporate boundaries the following areas, contiguous to and adjoining the present corporate boundaries of the City of Aberdeen, being and of that piece, parcel or tract of land shown on Exhibit A hereto, and which is more particularly and separately described as follows:

    CONTAINING 55.3775 acres of land, more or less, as surveyed by Frederick Ward  Associates, Inc.

    BEGINNING for the same at a stone heretofore set at the beginning of the twelfth or South 54° 19’ 33” East 451.40 feet line of that tract or parcel of land described in Exhibit 2 of the Deed of Partition by Iola R. Michael unto Beverly M. Close, Beatrice Smith Maybank and Frank Stacy Smith, III dated March 17, 1986, as recorded among the land records of Harford County in Liber CGH 1314, folio 074. Said point of beginning also bears coordinates, referenced to the Maryland Coordinate System (NAD83/CORS96) of North 670088.4279 and East 1552413.0622. Thence, from the point of beginning, binding on a part of said twelfth line and binding on the sixth or South 53° 43’ 58” West 743.45 feet line of the parcel described in Resolution No. 137, Charter Amendment No. 12 of the municipal corporation charter of the City of Aberdeen dated March 25, 1966, as now surveyed,

    1) South 53° 33’ 11” West  394.45 feet to intersect the easterly right of way of Maryland Route 22, Northern Thruway, a right of way of varying width as shown on State Highway Administration Plats No. 53533 and 36046. Thence, leaving the present Corporate Limits of the City of Aberdeen and binding on the said easterly right of way line of Maryland Route 22 as conveyed by Beverly M. Close, Beatrice Smith Maybank and Frank Stacy Smith, III to the State Highway Administration of the Department of Transportation by a deed dated December 30, 1993 as recorded among the land records of Harford County in Liber CGH 2066, folio 671 and by  J. Smith Michael and Catherine I. Michael, et al to the State Roads Commission of Maryland by a deed dated June 12, 1969, as recorded among the land records of Harford County in Liber GRG 825, folio 003  the ten following courses;

    2) South 20° 55’ 39” East 164.30 feet,

Hopkins and F.M. Hopkins in the Judgment on the Declaration of Taking No. 2 in the District Court of the United States for the District of Maryland, Case No. 1708, recorded among the land records of Harford County in Liber GCB 276, folio 012,

    12) North 58° 03’ 59” East 515.23 feet to a bent 5/8” rebar heretofore set. Thence, leaving the said acquisition by the United States of America and binding on the second course of the parcel described in Liber CGH 1314, folio 074 and binding reversely on the twelfth or South 21° 57’ 47” West 1332.78 feet line of that tract or parcel of land described in a Confirmatory Deed by Iola R. Michael, et al to Iola R. Michael dated August 12, 1999, as recorded among the land records of Harford County in Liber CGH 3102, folio 732,

    13) North 21° 24’ 30” East 1332.78 feet to a rebar heretofore set with identifying cap ‘Highland Survey PLS 413’. Thence, leaving the last mentioned conveyance and binding on the first and second courses of that tract or parcel of land described in a Deed of Easement by The Pusey Family LLC to Harford County, Maryland dated June 17, 2004, as recorded among the land records of Harford County in Liber JJR 5467, folio 332 and as shown on a plat entitled “Boundary Plat, Lands of Pusey, LLC” as recorded among the land records  of Harford County in Plat Book JJR 115, folio 33 and being that tract or parcel of land conveyed by John M. Pusey and Phyllis P. Pusey to The Pusey Family LLC by a deed dated December 31, 1998 as recorded among the land records of Harford County in Liber CGH 2962, folio 097,

Thence, leaving the outlines of The Pusey Family LLC and binding on a part of the second of South 59° 32’ West 400 feet line of the second or 400’ by 200’ parcel described in a deed by the United States of America to the Commissioners of Aberdeen dated August 14, 1956, as recorded among the land records of Harford County in Liber GRG 468, folio 539,

Thence, leaving the last mentioned parcel and binding on the fifth through the ninth courses of that tract or parcel of land conveyed by Beatrice Smith Maybank, Beverly M. Close and Frank Stacy Smith, III to the City of Aberdeen by a deed dated April 28, 1997, as recorded among the land records of Harford County in Liber CGH 2533, folio 943, the five following courses;

    17) South 11° 56’ 24” East 92.45 feet,

    21) South 88° 20’ 49” West 135.41 feet to intersect the eighth course of the aforesaid parcel described in Liber CGH 1314, folio 074. Thence, binding thereon and on a part of the fifth or South 50° 54’ 38” West 720.65 feet line of Parcel No. 1 of those tracts or parcels of land conveyed by Rigdon Manor, Inc. to the State of Maryland to the Use of the State Roads Commission by a deed dated May 8, 1959, as recorded among the land records of Harford County in Liber GRG 525, folio 451,

    22) South 52° 14’ 33” West 94.84 feet to intersect the fourteenth or North 31°39’21” West  209.56 feet line of the parcel described in Resolution No. 1 by the Commissioners of Aberdeen dated June 6, 1956, providing for the annexation of certain land to the Corporate Limits of the Town of Aberdeen. Thence, continuing, binding on the remainder of the eighth course and on the ninth through the eleventh courses of the aforesaid parcel described in Liber CGH 1314, folio 074 and the area specifically excluded from the said Resolution No. 1, three courses,

    23) South 52° 14’ 33” West 2.98 feet, Thence, binding on the outlines of that tract or parcel of land conveyed by the State Highway Administration of the Department of Transportation to the City of Aberdeen by a deed dated December 2, 1992, as recorded among the land records of Harford County in Liber CGH 1910, folio 662,

    24) South 25° 02’ 36” East 97.67 feet,

    25) South 36° 12’ 46” East 869.53 feet to intersect the twelfth course of the aforesaid Resolution No. 1 at a point lying South 53° 40’ 16” West 4.60 feet from a concrete monument heretofore set (Monument No. 13 in Resolution No. 1). Thence, continuing on the said eleventh course of Liber CGH 1314, folio 074 and binding on the fifth course of the aforesaid Resolution No. 137,

    26) South 36° 12’ 46” East 397.40 feet to the point of beginning hereof.

    BEING that tract or parcel of land acquired by Beverly M. Close, Beatrice Smith Maybank and Frank S. Smith, III, as trustee of the Frank S. Smith, III Trust dated December 30, 1999, as follows;

    1) a ½ interest of Beverly M. Close, as to a 1/6 interest by the will of Beatrice P. Michael recorded among the will records of Harford County in Liber TLA 26, folio 574; as to a 1/3 interest by a deed from Iola R. Michael dated March 17, 1986 as recorded among the land records of Harford County in Liber CGH 1314, folio 074.

    2) a ¼ interest of Beatrice Smith Maybank, as to a 1/24 interest by a deed from Beatrice M. Smith dated December 21, 1982, as recorded among the land records of Harford County in Liber HDC 1178, folio 382; as to a 1/24 interest by a deed from Beatrice M. Smith dated February 14, 1983, as recorded among the land records of Harford County in Liber HDC 1181, folio 221; as to a 1/6 interest by a deed from Iola R. Michael dated March 17, 1986, as recorded among the land records of Harford County in Liber CGH 1314, folio 074.

    3) a ¼ interest of Frank S. Smith, III, as trustee of the Frank S. Smith, III Trust dated December 30, 1999, by a deed from Frank Stacy Smith, III dated March 13, 2000, as recorded among the land records of Harford County in Liber CGH 3246, folio 097.

    WHEREAS, on the 2nd day of August, 2006, there was formally presented to the City of Aberdeen a written consent to this Resolution signed by the owners of not less than twenty-five percent (25%) of the assessed valuation of the real property located in the area to be annexed, requesting that the corporate boundaries of the City of Aberdeen be enlarged by annexing the area so described.

    WHEREAS, the Mayor and City Council of the City of Aberdeen have caused to be made a verification of the signatures on said consent to annexation and have verified that the persons signing that petition represent at least twenty-five percent (25%) of the persons who reside in the area to be annexed and who are registered to vote in the county elections for Harford County in which said area is located, and that the persons signing the consent to annexation are the owners of at least twenty-five percent (25%) of the assessed valuation of the real property located in the area sought to be annexed.

    WHEREAS, it appears that the consents meet all of the requirements of law.

    Section 1.  NOW, THEREFORE, BE IT RESOLVED, by the Mayor and City Council of the City of Aberdeen, that the corporate boundaries of the City of Aberdeen be and the same are hereby enlarged by adding or annexing thereto the areas contiguous to and adjoining the present corporate boundaries as particularly described in the aforesaid metes and bounds survey property description above-stated in this Resolution.

    Section 2.  AND IT BE FURTHER RESOLVED, that the conditions and circumstances applicable to the change in the said corporate boundaries and to the residents and the property in the area so annexed are as follows:

    (a)  That the persons residing in the area to be annexed and the owners of all property therein, shall be generally subject to the provisions of the Charter of the City of Aberdeen.

    (b)  That the designation of the zoning classification of the land lying within the area herein described and hereby annexed shall be B-3 Highway Business District as described in the Code of the City of Aberdeen, and shall be subject to all provisions and conditions of said Ordinance which are applicable to the B-3 Highway Business District..

    Section 3.  AND BE IT FURTHER RESOLVED, in accordance with Section III(a) of the Charter of the City of Aberdeen, the description of the Corporate Boundaries of the City of Aberdeen is hereby amended by adding the above-described property to the Corporate limits of the City of Aberdeen.

    Section 4.  AND BE IT FURTHER RESOLVED, that this Resolution shall become effective at the end of forty-five (45) days following its final enactment provided that no Petition for Referendum hereon shall have been filed as permitted by law.



    ORDINANCE NO. 715-06, AN ORDINANCE TO AMEND SECTION 46-1 OF THE ABERDEEN CODE, CHAPTER 46, ARTICLE I, BUILDING STANDARDS.

    EFFECTIVE DATE: October 8, 2006

    WHEREAS, the City adopted Ordinance No. 617-02 on June 10, 2002, and

    BE IT ORDAINED AND ENACTED that Chapter 46, Building Construction, Article I, Building Standards, Section 46-1, be and is hereby deleted and the following enacted in lieu thereof as follows:

          The City adopts by reference the 2003 International Building Code (IBC), the 2003 International Residential Code, 2003 National Standard Plumbing Code with the 2004 supplement, and the 2005 National Electrical Code, with certain amendments adopted and published by the National Fire Protection Association with local modifications and all appendices and supplements as enforced by Harford County and the City of Aberdeen government as fully set forth here in, save such changes, amendments, revisions, deletions, subsections, and/or additions as specified in the Chapter.

          All building construction in the City shall meet the standards and requirements of the International Building Code as modified by Harford County government or the City of Aberdeen. All electrical and plumbing installations in the City shall meet the standard requirements of the National Electrical Code and National Standard Plumbing Code, except as modified by Harford County government or the City of Aberdeen.

          The City of Aberdeen adopts the following amendments to the above-referenced codes:

          The Director of Public Works will serve as Building Official for the City of Aberdeen.

          Whenever Harford County is referred to, it shall include the City of Aberdeen.

          The Department of Inspections, Licenses, and Permits shall include the City of Aberdeen and its appropriate Departments, including the Department of Public Works.

          The Department of Building Safety shall include the City of Aberdeen and its appropriate Departments, including the Department of Public Works.

          Section 101.1 of the 2003 IBC: Insert the words "City of Aberdeen" as the jurisdiction.

          Section 104.1 of the 2003 IBC: The "building official" shall refer to the Director of the Department of Public Works of the City of Aberdeen.

          Section 108.2 of the 2003 IBC: Include the words "in accordance with the fee schedule adopted by the City of Aberdeen."

          Sections 82-2.A.(1) and (2) of Harford County Bill No. 05-46 are deleted.

          References to "Premises Identification" shall include Section 48-2 of the Aberdeen Code.

    Upon motion duly made and approved by the City Council, the above Ordinance is hereby adopted and shall be effective at the expiration of twenty (20) calendar days after date of passage.



    RESOLUTION NO.   700-06,  CHARTER AMENDMENT NO.  80

    WHEREAS, on the 8th day of May, 2006, there was formally presented to the City of Aberdeen a written consent to this Resolution signed by the owners of not less than twenty-five percent (25%) of the assessed valuation of the real property located in the area to be annexed, requesting that the corporate boundaries of the City of Aberdeen be enlarged by annexing the area so described.

    WHEREAS, The Mayor and City Council of the City of Aberdeen have caused to be made a verification of the signatures on said consent to annexation and have verified that the persons signing that petition represent at least twenty-five percent (25%) of the persons who reside in the area to be annexed and who are registered to vote in the county elections for Harford County in which said area is located, and that the persons signing the consent to annexation are the owners of at least twenty-five percent (25%) of the assessed valuation of the real property located in the area sought to be annexed.

    WHEREAS, it appears that the consents meet all of the requirements of law.

    Section 1.  NOW, THEREFORE, BE IT RESOLVED, by the Mayor and City Council of the City of Aberdeen, that the corporate boundaries of the City of Aberdeen be and the same are hereby enlarged by adding or annexing thereto the areas contiguous to and adjoining the present corporate boundaries as particularly described in the aforesaid metes and bounds survey property description above-stated in this Resolution.

    Section 2.  AND IT BE FURTHER RESOLVED, that the conditions and circumstances applicable to the change in the said corporate boundaries and to the residents and the property in the area so annexed are as follows:

    (a)  That the persons residing in the area to be annexed and the owners of all property therein shall be generally subject to the provisions of the Charter of the City of Aberdeen.

    (b)  That the designation of the zoning classification of the land lying within the area herein described and hereby annexed shall be R-3, High Density Residential District and shall be subject to the Planned Unit Development District (PUD), as described in the Code of the City of Aberdeen, and shall be subject to all provisions and conditions of said Ordinance which are applicable to the R-3 High Density Residential District and the Planned Unit Development District (PUD).; and

    Section 3. AND BE IT FURTHER RESOLVED, that an Annexation Agreement will be executed between the City Council, the Petitioners, other interested parties and landowners.  The Annexation Agreement shall bind the land that constitutes the annexed area. No development will occur on the annexed area until the Annexation Agreement is executed and recorded in the land Records of Harford County.  The Annexation Resolution will not be filed officially with the State of Maryland’s Legislative Reference until the Annexation Agreement is executed.  

    Section 4.  AND BE IT FURTHER RESOLVED, in accordance with Section III(a) of the Charter of the City of Aberdeen, the description of the Corporate Boundaries of the City of Aberdeen are hereby amended by adding the above-described property to the Corporate limits of the City of Aberdeen.

    Section 5.  AND BE IT FURTHER RESOLVED, that this Resolution shall become effective at the end of forty-five (45) days following its final enactment provided that no Petition for Referendum hereon shall have been filed as permitted by law.




    ORDINANCE NO. 712-06, AMENDMENT TO "SIGN" CODE

    AN ORDINANCE to repeal Chapter 115 "Signs" and Tables 1, 2, and 3 of the Code of the City of Aberdeen as approved in Ordinance No. 448-95.

    Section 1. Title

    This chapter shall be known and cited as the "Aberdeen Sign Code" and supersedes the provisions regarding signs in Ordinance No. 448-95.

    Section 2. Application

    This Code shall be effective within the territorial limits of the City of Aberdeen.

    Section 3. Purpose

    The purpose of this chapter is to regulate all exterior signs so as to protect property values and the character of the various neighborhoods; to preserve and enhance natural scenic beauty; protect health, safety, and morals; and to promote the general welfare.

    Section 4. Definitions and Interpretations

    For the purposes of this chapter, the following words and phrases have the meaning provided below; words and phrases not specifically included are defined in the chapter entitled Zoning Code:

    1. Animated Sign. Any sign that uses movement or change of lighting to depict action or create a special effect or scene.

    2. Banner Sign. Any sign made of fabric or any non-rigid material that is permanently mounted to a pole or a building

    by a permanent frame at one or more edges. National flags,

    state, county or municipal flags, or the official flag of

    any institution or business shall not be considered banners.

    3. Beacon. Any light with one or more beams directed into the

    atmosphere or directed at one or more points not on the same

    lot as the light source; also, any light with one or more

    beams that rotate or move.

    4. Billboard Sign. Any freestanding outdoor advertising sign that promotes or advertises products, services, activities

    or businesses not related to the site or building or use on which it is located.

    5. Board. The Aberdeen Board of Appeals.

    6. Building Marker Sign. Any sign indicating the name of a building, date and incidental information about its

    construction, which sign is cut into a masonry surface or on a bronze tablet or other permanent material.

    7. Canopy Sign. Any sign that is a part of or attached to an awning, canopy, or other fabric, plastic, or structural

    protective cover over a door, entrance, window, or outdoor

    service area. A marquee is not a canopy.

    8. Changeable Copy Sign. A sign or portion thereof with

    characters, letters, or illustrations that can be changed

    or rearranged by hand without altering the face or the surface of the sign. A sign on which the message changes throughout the day shall be considered an animated sign and not a changeable copy sign for purposes of this Code. A sign on which the only copy that changes is an electronic or mechanical indication of time or temperature shall be considered a "time and temperature" portion of a sign and not a changeable copy sign for purposes of this chapter. This definition does not apply to portable signs.

    9. District. The zoning district.

    10. Enforcement Officer. The Director of Planning & Community

    Development or a designee.

    11. Erect. Build, construct, attach, hang, place, suspend, or

    affix, and shall also include the painting of wall signs,

    but shall not include the changing of advertising copy or

    messages on billboards and other advertising structures

    which are designed for replaceable copy.

    12. Face or Surface. The surface of the sign upon, against, or

    through which the message is displayed or illustrated on the

    sign.

    13. Flag. Any fabric, banner, or bunting containing distinctive

    colors, patters, or symbols, used as a symbol of a government, political subdivision, institution, business, or

    other entity.

    14. Freestanding Sign. Any sign supported by structures or

    supports that are placed on, or anchored in, the ground

    that are independent from any building or other structure.

    15. Illuminated Sign. Any sign which has characters, letters,

    figures, designs or outline illuminated by electric lights

    or luminous tubes as part of the sign.

    16. Incidental Sign. A sign, generally informational, that

    has a purpose secondary to the use of the lot on which it is

    located, such as "no parking," "entrance", "loading only",

    "telephone", "no trespassing", "beware of dog", and other

    similar directives.

    17. Informational Signs. Any sign for a political, charitable,

    educational, or religious function.

    18. Lot. Any piece or parcel of land or a portion of a

    subdivision, the boundaries of which have been established

    by some legal instrument of record, that is recognized

    and intended as a unit for the purpose of transfer of

    ownership.

    19. Maintenance. The painting, repainting, cleaning and

    other repair of a sign or structural trim unless a

    structural, electrical, or message change is made.

    20. Marquee. Any permanent roof-like structure projecting

    beyond a building or extending along and projecting

    beyond the wall of the building, generally designed

    and constructed to provide protection from the weather.

    21. Marquee Sign. Any sign attached to, in any manner, or

    made a part of a marquee.

    22. Monument Sign. A permanent ground sign generally constructed out of brick, stone, or cast concrete material supported on a concrete foundation across the entire base of the structure and which may have an open space between the bottom of the sign and the ground that does not exceed one (1) foot. For purposes of this code, a monument sign is not a freestanding sign.

    23. Nonconforming Sign. Any sign that does not conform to the

    requirements of this chapter.

    24. Parapet. The extension of a false front or wall above a

    roofline.

    25. Pennant Sign. Any lightweight plastic, fabric, or other

    material, whether or not containing a message of any kind,

    suspended from a rope, wire or string, usually in a series,

    designed to move in the wind. Pennants used for real estate

    development are not included within this definition.

    26. Political Campaign Sign. Signs announcing candidates seeking public office and advocating support or defeat of public issues.

    27. Portable Sign. Any sign not permanently attached to the

    ground or other permanent structure, or a sign designed

    to be transported, including, but not limited to, signs

    designed to be transported by means of wheels; signs

    converted to A or T-frames; menu and sandwich board signs;

    balloons used as signs; umbrellas used for advertising;

    and signs attached or painted on vehicles parked and

    visible from the public right-of-way.

    28. Principal Building. The building in which is conducted

    the principal use of the lot on which it is located.

    Storage buildings, garages, and other clearly accessory

    uses shall not be considered principal buildings.

    29. Private Traffic Control Sign. Signs directing traffic

    movement onto a premises or within a premise not to

    exceed six (6) square feet in area for each sign.

    30. Project Development Signs. Temporary signs for undeveloped

    parcels offering the sale, rental, or lease of the property.

    31. Projecting Sign. Any sign affixed to a building or wall in

    such a manner that its leading edge extends more than

    six inches beyond the surface of such building or wall.

    32. Public Signs. Signs erected by or on the order of public

    official in the performance of duty, such as, legal notices,

    directional signs, regulatory signs, warning signs,

    informational signs, or decorative banners.

    33. Real Estate Signs. Real estate signs not exceeding ten

    (10) square feet and located on the subject property or

    tract. Real estate signs must be removed upon transfer

    of the real property.

    34. Roof Sign. Any sign erected and constructed wholly on and

    over the roof of a building, supported by the roof

    structure, and extending vertically above the highest

    portion of the roof.

    35. Roof Sign, Integral. Any sign erected or constructed as

    an integral part of a normal roof structure of any

    design, such that no part of the sign extends vertically

    above the highest portion of the roof and such that no

    part of the sign is separated from the rest of the

    roof by a space of more than six inches.

    36. Setback. The distance from the property line to the

    nearest part of the applicable building, structure, or

    sign, measured perpendicularly to the property line.

    37. Sign. Any device, fixture, placard, or structure that

    uses any color, form, graphic, illumination, symbol,

    or writing to advertise, announce the purpose of, or

    identify the purpose of a person, entity, or to communicate

    information of any kind to the public including banners

    and pennants.

    38. Sign Area. The area surfaces including the outer

    extremities of all letters, figures, characters, and

    delineations or surface area making contact with the

    outer support of the sign background. Columns, pylons, or buildings, or part thereof, shall not be included in the sign area unless used for advertising purposes.

    39. Special Development District. A district, outlined in the

    City's Zoning Code, which applies to but is not limited to

    the following types of development: townhouses, zero-lot

    line housing, planned unit developments, shopping centers

    and office/research/educational parks, condominiums,

    cooperatives, and common areas.

    40. Street. A strip of land subject to vehicular traffic

    (as well as pedestrian traffic) that provides direct or

    indirect access to property, including, but not limited

    to, alleys, avenues, boulevards, courts, drives, highways,

    lanes, places, roads, terraces, trails, or other

    thoroughfares.

    41. Street Sign. A sign that identifies a public road, alley, avenue, boulevard, court, drive, highway, lane, place, road, terrace, trail, or other types of thoroughfares.

    42. Street Frontage. The distance, for which a lot line adjoins a public street, from one lot line intersecting said street to the furthest distant lot line intersecting the same street.

    43. Structure. Anything constructed, the use of which

    requires permanent location on the ground or is attached to

    something having a permanent location on the ground.

    44. Structure Trim. The molding, battens, cappings, nailing

    strips, latticing, and platforms which are attached to the

    sign structure.

    45. Suspended Sign. A sign that is suspended from the underside

    of a horizontal plane surface and is supported by such

    surface.

    46. Temporary Sign. Any sign that is used only temporarily

    and is not permanently mounted for a period not exceeding

    thirty (30) consecutive days or sixty (60) days in any one- year period.

    47. Wall Sign. Any sign attached parallel to, but within

    six inches of a wall, painted on the wall surface of,

    or erected and confined within the limits of an outside

    wall of any building or structure, which is supported

    by such wall or building, and which displays only one

    sign surface.

    48. Window Sign. Any sign, pictures, symbol, or combination

    thereof, designed to communicate information about an

    activity, business, commodity, event, sale, or service,

    that is placed inside a window or upon the windowpanes

    or glass and is visible from the exterior of the window.

    Section 5. Sign Permits and Fees

    1. Permit Requirements. It shall be unlawful for any person to erect, alter, or relocate any sign or other advertising structure as defined in this article without first obtaining a sign permit and making payment of the required fee. All

    illuminated or electrically operated signs shall, in addition, be

    subject to the provisions of the Harford County Electrical Code and any permit fees required there under. Violations of this Chapter shall constitute a municipal infraction.

    2. Application. Application for a sign permit shall be signed by the owner or authorized agent. The sign permit application shall contain the name and address of the sign/property owner; name and address of the sign erector; drawings showing the copy, design, dimensions, heights, and location of the sign; and other pertinent information as may be required to insure compliance with this Code.

    3. Fees. Fees for sign permits shall be as established and specified in the City of Aberdeen's Schedule of Rates and Charges.

    4. Nullification. A sign permit shall become null and void if the work for which the permit was issued has not been completed within twelve (12) months after the date of issuance of the permit.

    5. Issuance and Revocation. The Enforcement Office may refuse to issue any permit or may revoke any permit issued upon failure to comply with any provisions of this Code.

    6. Violations. Any sign erected, placed, attached, altered, reconstructed, or modified after the adoption or amendment of this Code shall conform to the regulations contained herein.

    Section 6. Calculation of Sign Area

    1. Double-Faced Signs. One (1) face of a sign having obverse and reverse faces shall be considered in calculating the sign area. In the event that the area of faces is different, the face having the larger area shall determine the area of the sign.

    2. Multi-faced or Curved Surface Signs. The sign of a multi-faced or curved surface sign shall be calculated from dimension derived from its greatest plane projection.

    3. Irregularly Shaped Signs. The area of irregularly shaped signs shall be calculated by totaling the area of one or more rectangles completely enclosing the extremities of the sign.

    4. Modular Signs. The area of signs consisting of two (2) or more individual letters, characters, numbers, or figures shall be determined by the area of a described rectangle completely enclosing the extremities of all of the individual letters, characters, numbers or figures; provided, however, that if individual modules are mounted on a background other than an integral structure component of a building, the entire area of such a background shall be calculated as sign area.

    5. Cylindrical Signs. The area of cylindrical signs shall be computed by multiplying one-half (1/2) of the circumference by the height of the sign.

    Section 7. Structural Requirements of Signs

    All signs and supporting structures shall comply with the pertinent requirements of the International Building Code (IBC) as adopted by the City of Aberdeen.

    Section 8. Miscellaneous Provisions

    1. No sign or sign structures shall create a safety hazard.

    2. No sign may be located so that it substantially interferes with the view necessary for pedestrians or motorists to proceed safely through intersections or to enter or exit public streets or private roads.

    3. No sign may be erected so that its location, color, size, shape, nature, or message would obstruct the view of or be confused with official traffic signs or other signs erected by government agencies.

    4. Freestanding and/or monument signs shall be securely fastened to the ground or to some other substantial support. No freestanding sign shall be placed within fifty (50) feet of residentially zoned property. The height of any freestanding sign shall be no more than thirty-five (35) feet from grade in commercial and industrial districts. Monument signs shall have a copy area not exceeding a horizontal to vertical ratio of two to one. The structure of a monument sign shall not exceed eight (8) feet in height.

    5. Signs containing statements, words, or pictures of an

    offensive, obscene, indecent, or immoral character which offend public morals or decency of the community are prohibited.

    6. Signs of a size, location, movement, content, coloration, or manner of illumination which may be confused with or construed as a traffic control device or which hide from view any permitted signs or which distract or obstruct the view of road or pedestrian traffic in any direction at a road intersection shall be prohibited.

    7. Signs that are not commercially produced are prohibited in commercial or industrial zoning districts.

            Political campaign signs.

              a. Political campaign signs shall not be displayed on City property, on utility poles, or in such a way as to present a danger to person or property, or to limit the visual field of drivers or pedestrians.

              No sign shall be placed within ten (10) feet of the road right-of-way and shall be placed in such a manner so as not to impede vision.

              Political campaign signs may be displayed thirty (30) days prior to the primary election and shall be removed seven (7) days after the general election or within seven (7) days after the primary if the candidate is not a candidate for the general election. Signs advocating political issues may be displayed within thirty (30) days and shall be removed within seven (7) days after the election relating to the issue.

              A permit for a political campaign sign shall only be required at the campaign headquarters.

              Political campaign signs may be no larger than six (6) square feet.

    9. Project development signs shall be set back at least ten (10) feet from the road right-of-way, shall not exceed ten (10) feet in height above the road grade, and shall not exceed the sizes as expressed in Table 3. Project Development Signs must be removed within fifteen (15) days after sale of the last lot in the development.

    10. Vehicular signs (signs painted or mounted on the side or rear of trucks and trailers) parked along a right-of-way are prohibited.

    11. No sign shall obstruct a means of ingress or egress from a building structure.

    12. Signs shall be permitted for institutions such as churches and funeral homes located within a residentially zoned area.

    13. Informational signs shall be set back ten (10) feet from the road right-of-way. These signs shall not exceed six (6) square feet in sign area and shall not exceed six (6) feet in height above the road grade. All information signs may be posted ten (10) days prior to an event and shall be removed within twenty-four (24) hours after the event.

    14. Projecting signs shall be at least two (2) feet away from the vertical street curb line or improved shoulder edge of the travel way, and shall project no more than forty-two (42) inches from the wall. There shall be a clearance of at least eight (8) feet from the top of the sidewalk to the bottom edge of the sign, or fourteen (14) feet for vehicle access.

    15. Signs that produce noise or sounds, or emit smoke, vapor, particles, or odor are prohibited.

    16. Signs shall not be placed within rights-of–way or buffer yards between business or industrial uses and residential uses. Signs placed in violation of this provision are subject to removal by the City without notice.

    Section 9. Inspection, Maintenance and Removal

    1. Inspection. Signs for which a permit is required may be inspected by the Enforcement Officer or designee for compliance with this article.

    2. Maintenance. Signs and components shall be maintained so as not to create a safety hazard, in good appearance, repair, and condition, and against breakage, material discoloration, and defects in or omission of material components.

    3. Removal.

    a. If any sign advertises a business, service, commodity, accommodation, attraction, or other enterprise or activity that is no longer operating, or being offered or conducted, that sign shall be considered abandoned and shall, within ninety (90) days after such abandonment, be removed by the sign owner, owner of the property where the sign is located, or other party having control over such sign.

    b. If the message portion of a sign is removed, leaving only the supporting "shell" of the sign, the owner of the property where the sign is located, or other person having control over such sign, shall, within thirty (30) days of the removal of the message portion of the sign, remove the remaining components of the structure with the exception of billboards.

    Section 10. Unlawful Cutting of Trees or Shrubs

    No person may, for the purpose of increasing or enhancing the visibility of any sign, damage, trim, destroy, or remove any trees, shrubs, or other vegetation located within the right-of-way of any public street or road, without the approval of the Enforcement Officer.

    Section 11. Nonconforming Signs

    1. No person may enlarge or increase the size of a non-conforming sign.

    2. A nonconforming sign may not be moved or replaced except to bring the sign into complete conformity with this chapter.

    3. If a nonconforming sign is destroyed by natural causes, it may not thereafter be repaired, reconstructed, or replaced except in conformity with all the provisions of this chapter, and the remnants of the former sign structure shall be cleared from the land. A nonconforming sign is "destroyed" if damaged to an extent that the cost of repairing the sign to its former stature or replacing it with an equivalent sign equals or exceeds the value (tax value if listed for tax purposes) of the sign so damaged, or when there is a change in the use of the building requiring a new certificate of occupancy.

    4. The original message of a nonconforming sign may not be modified.

    5. All nonconforming signs shall be removed within two (2) years from the effective date of this chapter or an appeal made to the Aberdeen Board of Appeals for an extension.

    Section 12. Illumination

    1. The light from any illuminated sign or from any light source, including interior of a building, shall be so shaded, shielded, or directed that the light intensity or brightness shall not adversely affect surrounding or facing premises nor adversely affect the vision of motor vehicle operators.

    2. No sign shall have blinking or flashing lights or other illumination devices which have a changing light intensity, brightness or color, except signs designed to show the time, temperature, and other public service messages. Nothing contained in this Chapter shall, however, be construed as preventing the use of lights or decorations commemorating religious and patriotic holidays. Beacon lights or searchlights shall be temporarily permitted for advertising special events.

    3. No exposed reflective type bulbs and no strobe lights or incandescent lamps exceeding fifteen (15) watts shall be used on the exterior surface of any sign so as to expose the face of the bulb, light, or lamp to any public street or adjacent property except signs designed to show the time, temperature and other public service messages.

    Section 13. Signs Permitted for Special Development Districts

    1. Freestanding signs shall not exceed one (1) square foot in area for each foot of road frontage or four hundred (400) square feet, whichever is smaller. One such sign shall be permitted for each road frontage, but no more than two (2) such signs will be allowed per shopping center and not more than one per pad site. The maximum height of such sign shall be thirty-five (35) feet, and shall be set back at least twenty (20) feet from the property line.

    2. The total area of all signs erected on or attached to the structures within the shopping center shall not exceed four (4) square feet per foot of building width measured along the front wall of the building. If a building is located with frontage along more than one (1) street, sign area allowed will be calculated separately for each street frontage. Signs will not be on more than three sides of any structure. These restrictions apply to the following types of signs.

    a. Wall Signs

    b. Projecting Signs

    c. Marquees

    d. Canopy Signs

    3. Plans for these signs shall be submitted simultaneously as part of a master sign plan.

    Section 14. Commercial, Office, Research and/or Educational

    Park Signs

    Signs are permitted in commercial, office, research, and/or educational parks when in the judgment of the Planning Commission the scale and type of development warrant application of these special standards.

    1. One (1) general identification sign limited to one hundred fifty (150) square feet in area if mounted approximately parallel to the right-of-way or two (2) signs limited to seventy-five (75) square feet in area if angled to be read from opposite directions, shall be permitted for frontage of the tract on an arterial street. The maximum height of such sign shall be twenty-five (25) feet.

    2. Sign on buildings within the center may be erected as follows: for each ten (10) linear feet of building fronting on public parking areas one (1) sign, ten (10) square feet of area shall be permitted; each establishment will be permitted a maximum of four (4) signs totaling forty (40) square feet in area.

    Section 15. Sign Tables

    The following tables will be referenced for determining permitted signs, number of signs allowed and sign area for each sign in each zoning district:

    Section 16. Variances

    A. The Zoning Enforcement Officer as defined in this code may grant a variance of twenty-five percent (25%) of the total square footage of a sign, provided that the enlargement does not violate the Miscellaneous Provisions section of this chapter, does not constitute a safety hazard, and does not adversely affect the adjoining properties.

    B. The Board of Appeals may grant a variance from the provisions of this chapter, if by reason of configuration or irregular shape of the lot or by reason of topographic conditions or other exceptional circumstances unique to the lot or building, practical difficulty or unnecessary hardship would result.

    Section 17. Appeals

    Upon denial of an application for a sign permit by the enforcement officer, the applicant may file an appeal to the Board of Appeals.

    Section 18. Violations and Penalties

    1. Any owner or occupant who erects or alters, uses or permits the use of land, buildings, structures, or signs contrary to the provisions of this Chapter shall be deemed to have committed a municipal infraction as set forth in Chapter 16 and subject to the following fines:

    a. Warning – A warning notice to correct the violation within ten (10) days from the date of the notice shall be mailed, by certified and regular mail, to the owner, occupant, or tenant. b. First Offense - $100

    c. Second Offense - $250

    d. Third Offense - $400

    2. Notwithstanding the provisions herein for violations, the City may seek an injunction or other relief as may be available by law.

    3. The Zoning Enforcement Officer may remove any sign in violation of this Chapter upon ten (10) days notice to the owner or occupant. The cost of removal shall be paid by the owner and shall constitute a lien on the property.

    Upon motion duly made and approved by the City Council, the above ordinance is hereby adopted and shall be effective at the expiration of twenty (20) calendar days after date of passage.



    ORDINANCE NO. 714-06, AN ORDINANCE TO AMEND CHAPTER 142-7 AND 142-19 OF THE CODE OF THE CITY OF ABERDEEN

    142-7. Definitions. Replace the definition for Gourmet Food Establishment in its entirety.

    Gourmet Food Establishment.  A specialty retailer of not greater than 45,000 sq. ft. which offers for sale varieties of groceries, baked goods, fresh fish and meats, dairy products, beverages, fresh produce, prepared dishes for take out and/or ingredients for food preparation.  Within or adjacent to the premise, such establishments may also offer for sale beer, wine and liquor for off premises consumption. 

    Section 19: Zoning Districts and Boundaries. Replace (5) (b) and (5) (g) (1) through (5) in its entirety.

    M.   Integrated Business District

      

    (5) (b)   The minimum amount of an area to develop a mixed used development is 12 acres.  The mixed use development may include a combination of parcels that are under common ownership or control, or that part of an integrated scheme of development.  A restaurant with drive thru may be permitted in a mixed use development at a density of one such use per 10 acres of land.  See Appendix A.

    (5)  (g)  Building Setbacks.

     

    (1)  Major arterial road rights-of-ways, such as Churchville Road (Route 22) shall have a minimum building setback of 40 feet and shall have a landscaped buffer area within the setback area.

     

    (2)         Collector roads, such as Technology Drive and Long Drive, shall have a minimum building setback of 20 feet and shall have landscaped buffer areas within the setback area.

     

    (3)  Local roads, such as Gilbert Road, shall have a minimum building setback of 10 feet, and shall have a landscaped buffer within the setback area.

     

    (4)         Building placement on interior thoroughfare roads within a mixed-use development will be reviewed for creativity, uniqueness, and integration of uses by the planning officials.  When a lot within an MXUD does not abut a public road, no front, side, or rear yard building setback shall be required

     

    (5)         A minimum fifteen-foot landscaped buffer yard shall be required for any commercial use adjacent to an existing residential or other noncommercial uses.
